Subject: COMPLAINT UNDER SECTION 5 AND 18 (B) SUB SECTION-II OF THE
NATIONAL ACCOUNTABILITY BUREAU (NAB) ORDINANCE 1999, AGAINST THE HOLDERS OF
PUBLIC OFFICE FOR PUNISHMENT UNDER SECTION 10 OF NAB ORDINANCE FOR CAUSING
HUGE FINANCIAL LOSS TO THE NATIONAL EXCHEQUER BY CORRUPTION AND CORRUPT
PRACTICES
FACTS AND GROUNDS:
1. That the Respondents were deeply involved in millions of rupees scam. The
Ministry of Industries & Production’s move to seek tax and duty-free import
of fully-built 300 Black Cabs from the United Kingdom in a way that only one
bidder would be successful is being described here as violation of
procurement rules, as published in the daily “The Dawn” dated June 13,
2006.( Annex A)
2. That the respondents were facing charges of misusing the powers to allow
Mr Dawood Khan, an American national of Pakistan origin who owns the Prime
Transport Company, was working in United Kingdom whereas the Black Cab
Company has already closed its business in UK as reported in the newspaper
“Post” dated 17-6-2006. (Annex B)
3. That the tender for the import has appeared on inside pages of an Urdu
newspaper (“Jang” dated 7-6-2006) (Annex C) and is not available on the
Ministry’s own website or that of the Public Procurement Regulatory
Authority (PPRA). Under the rules, all tenders should be advertised in at
least two widely circulated Urdu and English dailies.
4. That the tenders allowed only 15 days to the bidders to arrange proof of
land acquisition, technical agreement with the foreign firm, manufacturing
such purpose built vehicles for joint venture, plan for annual production
capacity and plan for setting up facilities for after sale service.
Completion of these formalities in 15 days is impossible and allegedly shows
that it’s a tailored advertisement and the Ministry had already done an
underhand deal with the favoured party.
5. That both the Federal Minister for Industries & Production & State
Minister for Investment & Privatisation Government of Pakistan succeeded to
allot 400 acres precious land to Mr. Dawood Khan for the Black Cab Project,
with the connivance of Sindh Chief Minister, with possession at Dhanji
Karachi. (Annex D & E) despite the fact that the production of Black Cab has
ceased.
The above facts have been published in newspapers “Jang” dated 7-6-2006,
“The Dawn” dated 13-6-2006, and “POST” dated 17-6-2006 (Press clippings
attached for ready reference).
6. That the respondents in this complaint fall within the ambit of NAB
Ordinance 1999 for the purposes of investigation, trial and punishment.
7. That the respondents are reportedly guilty of corruption and corrupt
practices as a State Minister for Investment & Privatisation, abuse of power
as defined in Section 9 of the NAB Ordinance and as such is subject to
punishment under Section 10 of the NAB Ordinance 1999 based upon the above
facts and grounds.
CONCLUSION:
Based on the above facts and grounds, the respondent has shown wilful
indulgence in misusing their powers and corrupt practices under Section 9 of
the NAB Ordinance. Such persons are subject to punishment under Section 10
of the NAB Ordinance 1999.
As such the Chairman of the National Accountability Bureau is called upon to
initiate investigation in connection with matters set out hereinabove and
further proceed to file a Reference against the respondents for violating
the provisions of Section 9 of the NAB Ordinance punishable under Section 10
of the NAB Ordinance in competent court of law and proceed against those
concerned for violating Section 9 of the NAB Ordinance 1999.
